Can We have the name of registered trademark's name as part of our domain name.?
We are launching a website. The site allows website owners to list their site in the respective category. This is a premium service where in website owners need to pay for the listing. The site has social networking features where any body can join the site and give testimonials to the sites, rate them and vote for the sites. We are using a domain which is a combination of an already registered trademark plus "sites". So the domain name is like this xyzsites.com, where "xyz" is the name of the registered trademark. Our service is different from the xyz even though the social networking features are some what same. Please do let me know Where do I stand when it comes to legal issues in USA. Would be very greatfull for your advice. THANK YOU.
That would be a stark no. No matter what the similarities between your social network and the other, you cannot use their name.
Suppose Facebook called themselves "TheOtherMySpace.com". They would get into serious trouble.
Even if you're just affiliating for that social network, it's always a wise idea to check on the trademark and ask the parent company if you can use their name in your campaigns. You can't even use the misspelling of the name. That's about as bad as McDonalds and MacDowells (like in Eddie Murphy's "Coming To America"). Most of the time, they would say no.
It's generally a good idea to come up with a completely new name. You can always consult a lawyer for more details.
