Mental Illness as a criminal defense?
My grandfather committed an act in New York State which resulted in a judicial summons. After receiving the summons, he subsequently committed himself to a mental health center.
My question, as I'm very ignorant to the complexities of law: Can a defendant make an effect case in court by arguing the condition of his mental health, and what (if any) weight would checking ones-self into a mental health home/center/etc. weigh on the case AFTER the individual received the judicial summons?
It is my opinion that defendant will attempt to argue mental illness for his crime, and will attempt to argue that because of his mental state, he 'responsibly' admitted himself into a mental hospital to (perhaps) mitigate the courts ruling. Surely the courts must be cognizant of this kind of behavior and have some kind of way to argue back any such action as inexcusable, or am I wrong?

It sounds like you are speaking of a Molestation situation and if so the courts do not recognize it as a mental illness, but rather a criminal offense. The only consideration a court would give the treatment would be at sentencing if he is found guilty and then it would not be lowered by much.
